Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the CaterTrack website, web application, and mobile application (together, the “Service”), operated by Harsh Agrawal, a sole proprietor trading as "CaterTrack" (“CaterTrack”, “we”, “us”, or “our”).

By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund & Cancellation Policy. If you do not agree, do not use the Service.

CaterTrack is a software-as-a-service (SaaS) platform that helps catering businesses and party-plot venues manage orders, bookings, quotations, menus, customers, payments, invoices, and related operations. We may add, modify, or remove features from time to time to improve the Service.

You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate, current, and complete information and to keep it updated.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use. You are responsible for the actions of all users you invite into your group or business.

CaterTrack offers a free trial and paid subscription plans (currently Growth and Scale), billed on a monthly or annual basis as shown on our Pricing page. Prices are in Indian Rupees (INR) and, where applicable, are exclusive of taxes, which will be added as required by law.

• Free trial. New accounts may start on a 30-day free trial with full access. No payment is taken during the trial. If you do not upgrade to a paid plan, your access becomes read-only when the trial ends.
• Auto-renewal. Paid subscriptions set up as recurring (auto-pay) renew automatically at the end of each billing cycle using your authorised payment method, until you cancel. By subscribing to a recurring plan, you authorise us, through Razorpay, to charge the applicable fee each cycle.
• Plan changes & proration. When you upgrade or downgrade, the change applies immediately. We credit the unused portion of your current plan against the new plan and charge only the prorated difference (if any). The exact amount is shown to you for confirmation before you pay.
• Renewals & failed payments. If a renewal payment fails, we may retry it and may suspend or downgrade your access until payment is received.
• Price changes. We may change our prices. We will give you reasonable notice before a price change affects your renewal.

Payments are processed by Razorpay, our third-party payment gateway. By making a payment you also agree to Razorpay’s terms. We do not store your full card, UPI, or bank credentials. You represent that you are authorised to use the payment method you provide.

You may cancel your subscription at any time from your billing settings. Cancellation, refund eligibility, and how proration credits are handled are described in our Refund & Cancellation Policy, which forms part of these Terms.

You agree not to:

• use the Service for any unlawful, fraudulent, or infringing purpose;
• upload content that is illegal, harmful, or violates the rights of others;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• interfere with, disrupt, overload, or reverse-engineer the Service; or
• resell or sublicense the Service without our written permission.

You retain all rights to the business and customer data you enter into the Service (“Your Data”). You grant us a limited licence to host, process, and display Your Data solely to provide and support the Service.

You are responsible for the accuracy and legality of Your Data and for having the necessary rights and consents to process the personal data of your own customers through the Service.

The Service, including its software, design, branding, and content (excluding Your Data), is owned by CaterTrack and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not copy, modify, or create derivative works from the Service except as expressly permitted.

We work hard to keep the Service available and reliable, but it is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We may perform maintenance, updates, or modifications that temporarily affect availability.

To the maximum extent permitted by law, CaterTrack and its proprietor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid to us for the Service in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless CaterTrack and its proprietor from any claims, damages, liabilities, and expenses arising out of your use of the Service, Your Data, or your breach of these Terms or of applicable law.

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; provisions that by their nature should survive (such as data ownership, liability, and governing law) will survive.

These Terms are governed by the laws of India. Subject to any applicable law, the courts at Ahmedabad, Gujarat shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
